Rome, 12 January. (LaPresse) – The First Criminal Section of the Court of Cassation has declared inadmissible the appeal filed by lawyer Paolo Bevilacqua on behalf of Sebastiano Visintin, husband of Liliana Resinovich. The panel, chaired by Giacomo Rocchi, rejected the request for an evidentiary hearing aimed at obtaining a new forensic medical examination, considering the application to be without legal basis. The ruling, contained in the three pages of reasons filed, refers to the order issued on 18 November 2025, and was not limited to formal rejection but also ordered Visintin to pay the legal costs and €3,000 to the Cassa delle Ammende (Fines Fund), finding fault in the filing of an appeal deemed deficient and improper. According to the Court of Cassation, the order of the Trieste investigating magistrate of 30 June 2025 falls fully within the scope of the procedural system. The investigating magistrate had accepted the request of the Public Prosecutor’s Office, rejecting that of the defence, which had requested an expert report to clarify the causes, manner and date of Liliana Resinovich’s death, as well as the location where the body was kept. The Court deemed it inappropriate to speak of “abnormality”. The judges emphasised in their reasoning that the grounds for the appeal were “manifestly unfounded”.
