Gabriel Garcia claims the monitor beeps when he is with clients, scaring away business. It may also make him fall from ladders, he tells court.
A Florida man charged with participating in the Jan. 6 riots at the U.S. Capitol says the beeping on his court-ordered ankle monitoring is embarrassing and dangerous, and costing him customers at his aluminum siding business.
Gabriel Garcia is asking a judge to order the removal of the device, saying it threatens his Miami-based business when it goes off in front of would-be clients. The beeping has been followed by an “embarrassing” phone call from officials with pretrial services asking for his exact location. The Washington Post reports. Garcia also claims the monitor often gets stuck on ladders when he is working, and could make him fall.
The U.S. Justice Department said it opposes removing the ankle monitor.
